Federal Preemption: Backdoor Tort Reform
I am interested in hearing comments regarding this topic, particularly with motor vehicle safety standards. The FMVSS is a critical component in keeping the public safe.

I think it is important to have regulation, but when does regulation become burdensome to both the public and the manufacturer?
The question could also be addressed as Does the government need to heavily regulate Federal Motor Vehicle Safety Standards?
I think there are risks associated with anything you do. Nothing short of gross incompetence should need to punished- or watch-dogged for that matter.
Thanks for the comment. Yes, there are risks associated with anything that is made. If you had the choice to spend an extra $1 on the purchase of your vehicle, and it would make your family vehicle safer, wouldn't you want that for them?
It all comes down to being responsible and accountable business leaders. Federal standards were never meant to be a anything more than minimum standards, the gold standard of safety.
I'm not sure the public would ever cry foul about the burdens of Federal Regulations when the goal is to promote safety. If you take the analogy of September 11th and the war on terror compared to federal regs on autos, many Americans will gladly take the side of security then risk their family's safety, even if it means sacrifice or increase in costs.
As far as your "analogy", are you also saying that car manufacturers, etc. are terrorists and the "Osama bin Ladens" of society?
And plaintiffs' lawyers looking for big jury awards, like vultures scanning for roadkill, are the "Special Forces" of analogy I take it? Right.
