Barnett v. General Motors

Barnett, et al. v. General Motors Company, U.S.D.C., Western District of Tennessee, Western Division No. 95-2215-TU, and 96-2284-TU (consolidated litigation from Arkansas, Mississippi and Tennessee; certified as a class in Arkansas).

The Barnett Case was a class action law suit that covered three states. Basically, a tornado hit GM's facility in Memphis, Tennessee and damaged many new cars that were stored there. GM chose to repair the damage and sell the cars as if they were new, undamaged cars.

This is my most memorable case. I spent more than a decade fighting GM to ensure over 600 victims were compensated for this misrepresentation. It took a lot of hard work and determination, but in the end we were successful. According to GM's counsel, we obtained the highest per capita settlement in a non-personal injury class action case in GM's history.

I have an exhibit in my office of this case--it is a large timeline that demonstrates the years of work, pleadings, motions, court hearings, discovery exchanges, depositions, travel, etc.
