Morris v. Union Pacific Railroad, U.S. District Court, Western District of Arkansas, El Dorado Division.
Jury Verdict of $8 million. Many of my victories result in confidentiality agreements between the plaintiff and defendant. For that reason, this is the most recent victory I can discuss, since it is not bound by a confidentiality agreement.
A railroad crossing accident happened where a Union Pacific train and UPS truck collided. My client, Johnny Morris, was a wrecker company owner/operator was called to remove the wrecked UPS truck. Johnny arrived on the scene and set about his job by assessing the wreckage. Without warning, Union Pacific moved the train, and Johnny's head was crushed by the train. Johnny suffered severe, permanent injuries.
During our discovery, we realized that Union Pacific had destroyed key evidence in an effort to prevent Johnny from recovering for his injuries. We fought for Johnny through nearly six days of hearings. Finally, the judge hearing the case granted a sanctions order against Union Pacific for destroying the evidence. This allowed us to use the destruction of evidence adversely against Union Pacific at trial.
We eventually proceeded to trial. After the jury listened to evidence for ten days, they awarded $8 million dollars in compensatory damages to Johnny Morris.
