On June 14, 2021, health technology corporation Royal Philips NV announced a recall of its CPAP machines and ventilator devices. The recall affects all devices manufactured before April 26, 2021, and includes about 3-4 million CPAP machines.

Philips CPAP Recall

The recall is due to the inclusion of polyester-based polyurethane (PE-PUR) foam in Philips’ CPAP machines to make them quieter. This foam can degrade into dangerous carcinogenic particles that the user can inhale. Exposure to high levels of heat and humidity, plus using ozone to clean the machines, can speed up the process of degradation.

To qualify for a settlement, the plaintiff must have used a Philip Respironics CPAP, APAP, BiPAP, or mechanical ventilator for a certain amount of time before developing one of the following conditions:

  • Acute myeloid leukemia
  • Chronic obstructive pulmonary disease (COPD)
  • Leukemia
  • Non-Hodgkin’s lymphoma
  • Many types of cancer
  • Kidney, liver, or lung damage

There is growing evidence of Philips’ liability and misconduct. The case is expected to proceed quickly, with the possibility of settlements for individuals harmed by Philips’ products.
